These terms and conditions (the "Terms and Conditions") are the terms and conditions upon which Pickupflowers.com, a website of Gifting Inc. ("we/us/our") make this website (the "Pickupflowers.com") available to you and any of our services which are accessible on or via the Pickupflowers.com site (the " Pickupflowers.com Services").
These Terms and Conditions govern your use of the Pickupflowers.com Site and the Pickupflowers.com Services.
1.1 All products as depicted on this website (as may be varied from time to time) are available in every city of the respective country under which the product is displayed. Certain product ranges are available in selected delivery areas only and such information is given in the respective product pages.
1.2 Some flower and plant products may be harmful or poisonous (lilies in particular can be extremely toxic to cats), if you require further information before submitting an order please contact our Customer Service.
1.3 All products are subject to availability. In the event of any supply difficulties, we reserve the right to substitute with a product of equivalent value and quality, if the same is unavailable after order confirmation notification.
1.4 In the event that we are unable to supply all or part of your order (the product or any substitute product to you at all), we shall notify you as soon as possible and refund your payment in full no later than 1 - 2 business days after the intended delivery date or date of communication about the same, whichever is later.
1.5 A few products may not be available for same day delivery or other special delivery services. Such information is given in the respective product pages
Although a very rare case, please note in some locations we may need an additional 24 hours for the delivery of exotic flowers,cakes and fruit baskets.
We deliver only the finest quality of gifts/flower arrangements (branded items, wherever applicable), through our chosen partner network.
2.1 Prices listed within the Pickupflowers.com Service are valid for a maximum of 14 days of submitting your order.
2.2 Prices include VAT/GST for deliveries within the Australia, UK, Republic of Ireland and any other country that may be applicable, from time to time.
3.1 While to checkout (place the order), you will be required to provide us with a few personal details, including the phone number and/or email id, along with those of the intended recipient and all necessary payment details.
3.2 We accept payment by Paypal, Google Checkout, GT Pay and all major credit cards viz., Visa, Master, Amex & Discover.
3.3 By clicking on the 'place order' button at the end of the order process, you are consenting to be bound by our terms and conditions contained in these Terms and Conditions appearing anywhere on the Pickupflowers.com site.
3.4 Submitting your order is subject to our acceptance of this offer. We will send an email confirmation of your order details to advise that we are processing your order via the email address you provide. We will not consider ourselves bound by a contract with you until we have issued this email confirmation.
4.1 Selected products may not be available for delivery to certain localities. We try our best to provide with such information either on the respective product page, during checkout or will communicate you after you place your order.
4.2 We do not recommend courier deliveries to hospitals or funerals.
4.3 Shipping Methods – If you wish a delivery to be made within a specific time period, you can choose the respective shipping method shown on the respective product page. Please note that some shipping methods are subject to availability and that at certain times of the year the charges for the service may vary. The information and the available shipping methods is always provided on the respective product pages when you place your order.
4.4 Deliveries via courier services cannot be delivered at specific times. All orders will be delivered during the working day between 10am to 7pm (in the recipient time zone) during normal days (exceptions are such high gifting days like Valentine’s day, Mother’s day, etc during which deliveries can happen beyond this time range).
4.5 Deliveries are available only on the days mentioned (that can be selected) in the calendar provided on the respective product page. If you could not choose a delivery date of your choice, it means a delivery is not possible on that day. Please contact our customer service team if you need any suggestions on any other gifts that may be available for your choice day.
4.6 To avoid problems or delays with delivery, please ensure that you have provided with the full address details, including accurate postcode of the recipient and telephone number so that it would be easy for our delivery services to locate them. It would also be very helpful if you provide us with your daytime contact telephone number or e-mail address so that we can notify you in the event that any delivery problems are encountered.
4.7 Certain products cannot be delivered on a specific delivery date, but will be delivered during a delivery period (for eg., delivery in 2-4 business days or 3-7 business days, etc.). The time it takes for such products to be delivered is shown on the respective product page near the shipping method area. Please contact our customer service for any questions you may have about delivery dates for such products.
4.8 Whilst we agree to use all reasonable endeavours to ensure that delivery will be on the requested delivery date or during the delivery period, you acknowledge that actual delivery will be via a local florist (or local gift shop, as applicable) or for certain orders via third party courier service. In very occasional circumstances delivery on the requested terms will not be possible, in such circumstances you will be given prior notice wherever possible and we shall either make alternative arrangements or refund your payment in full in accordance with clause mentioned above.
4.9 In the case of delivery to certain locations, where a third party is involved, such as offices, hospitals, Funeral Directors, airports, hotels, ships and other business locations, the signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of delivery to your chosen recipient.
4.10 Please be aware that the carrier will deliver the goods to the address provided in good faith and we cannot accept responsibility if the intended recipient is no longer at that address and the receiver refuses or fails to return the items
4.11 Please note that where the carrier is unable to find someone to accept delivery, or unable to leave the delivery in a secure location, they will leave a card at the address for the recipient to make contact and re-arrange delivery. If the recipient fails to make contact in good time we reserve the right to charge for re-delivery to that or an alternative address.
4.12 Please note that if you order a number of items for delivery to the same address, they may be despatched separately and we cannot guarantee delivery on the same day/time.
4.13 We shall not be liable for any failure to perform in our obligations where such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service.

Such requests for cancellation/amendment are processed subject to the request before cut-off time (the time before which the order is processed/prepared).
5.1 We regret that you may not cancel an order once your order is shipped/dispatched.
5.2 You are entitled to cancel any payment at any time where fraudulent use has been made of your credit or debit card by another person not acting on behalf of you or as your agent and to be re-credited by us to the extent that such sums are not reimbursed by the card issuer in such circumstances.

7.1 (a) We accept liability for death or personal injury arising from our negligence.

The following terms and conditions apply to any Pickupflowers.com. gift card (a "Gift Card" or a "Card") purchased by you or someone on your behalf and issued by Pickupflowers.com in association with a gift program.
By purchasing the Card, accepting and retaining the Card, or using the Card, you agree to these terms and conditions (as amended from time to time). The terms "we", our" and "us" refer to Pickupflowers.com Unit, the issuer of the Card.
12.1 The full amount of each purchase, including taxes and fees, will be deducted from the funds held on the Card, up to the total funds available on the Card. The Card cannot be used to obtain cash or purchase other Gift Cards and you may not return merchandise or cancel services obtained with the Card for a cash refund.
12.2 No change or refund will be given where the sales transaction is for an amount (including applicable added fees and taxes) less than the balance on the Card but the remaining balance may be applied to future purchases.
